TheHigherUps Pulse Terms of Service

I. Introduction

Thank you for using TheHigherUps Pulse ("Service"), an assignment tracking platform created by TheHigherUps ("us", "we", or "our"). TheHigherUps Pulse pulse allows registered users to upload, create, modify, and delete assignments or classes to help manage and keep track of them. By accessing TheHigherUps Pulse, you agree to comply with and be bound to these Terms of Service ("Terms").

If you do not agree with any part of these Terms, do not access or use the Service or create an account with the Service

II. Eligibility

You may only access TheHigherUps Pulse if:

• You are above the age of 18; and,
• You have the legal capacity to enter into these Terms

By using TheHigherUps Pulse, you represent that you meet all the criteria stated above.

III. Acceptance of Terms

By accessing, viewing, creating an account, or using the Service, you confirm that you have read, understood, and agree to all of the Terms stated herein, and all applicable laws. Stop using the Service immediately if, at any point, you do not agree to these Terms.

IV. Changes to the Terms

TheHigherUps reserve the right, at any point, to modify, update, or change these terms. Upon modification of these Terms, the "Last Updated" date at the top of this page will reflect the date these Terms were modified. Continuing to use the service after any modifications to these Terms will constitute your acceptance to the changes made.

V. Description of the Service

TheHigherUps Pulse allows users to create classes and add assignments to the classes the user creates. This allows the user to keep track of different assignments for different classes in a neat and organized fashion.

TheHigherUps are not responsible for the users performance, grades (where applicable), or actions in any real world classes, courses, lectures, or other similar educational, personal, or work environments.

TheHigherUps may update, modify, change, or improve the functionality of the Service without any notice or obligation. Any feature on the Service is not guaranteed and may be altered or removed without notice.

We reserve the rights to modify, suspend, or remove TheHigherUps Pulse, in part or whole, without any notice to you. We are not responsible or liable to you or any third party for any such modifications, suspension, or discontinuation.

VI. User Conduct

When using TheHigherUps Pulse, you agree NOT to:

• Violate laws, regulations, or these Terms.
• Use the Service for any unlawful, threatening, abusive, harassing, defamatory, or otherwise objectionable purpose.
• Attempt to gain unauthorized access to interfere with or disrupt any servers or networks connected to the Service.
• Transmit viruses, malware, or other malicious code that could harm TheHigherUps, other users, or third parties.
• Collect or harvest any personal information or data from other users.
• Create or share content that infringes on any intellectual property or privacy rights of a third party.

Failure to adhere to adhere to these Terms may result in permanent or temporary account suspension

If your account is permanently suspended, any and all data linked to your account will be deleted 30 days after your date of suspension

When using TheHigherUps Pulse, your usage is also subject to our Privacy Policy. This describes how we collect, use, and share your personal information.

VIII. Disclaimers

• No Warranty. The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Accuracy of Information. We do not guarantee the accuracy, completeness, or timeliness of any information or data provided by TheHigherUps Pulse. Any reliance on such information is at your own risk.
• No Liability for Indirect Damages. TheHigherUps will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of TheHigherUps Pulse.
• Aggregate Liability Cap. In no event will TheHigherUps' total liability exceed the amount you paid us, if any, in the 12 months preceding the event giving rise to the liability or one hundred US dollars (USD $100), whichever is greater.

IX. Indemnification

You agree to defend, indemnify, and hold harmless TheHigherUps and its affiliates, officers, directors, employees, and agents, from and against all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of TheHigherUps Pulse or any activities under your account;
• Your breach or alleged breach of these Terms;
• Your violation of any law or the rights of a third party.
